Dear Heath Baldner:

By letter dated March 21, 2025 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML25080A348), as supplemented on April 18, 2025 (ML25108A158), you submitted an application to the U.S. Nuclear Regulatory Commission (NRC) for the amendment of the MAGNASTOR Cask Storage System certificate of compliance (CoC). In your application, you requested the following changes:

Allows an alternate method to determine the free volume inside a loaded canister and an alternate method to measure the amount of helium placed inside the canister to assure that Technical Specification limits for Helium density inside the Transportable Storage Canister (TSC) are met.

Clarifies that mixed loadings of different assembly types and/or assembly subtypes within a single TSC is acceptable.

The purpose of this e-mail is to provide you the results of the NRC staffs acceptance review of this proposed action request. The staff determined that the application contains sufficient technical information to allow the staff to complete a detailed technical review.

The acceptance review is also intended to identify any readily apparent deficiencies related to the characterization of the regulatory requirements or cask licensing basis.

The NRC staff reviewed your application and concluded that it includes technical information in sufficient detail to enable the staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed request in terms of regulatory requirements and the protection of public health and safety and the environment. Given the more limited scope and depth of the acceptance review compared to the detailed technical review, issues that affect the staffs ability to complete the technical review may still be identified despite the acceptance review being deemed adequate. If additional information is needed, you will be notified by separate correspondence.

The NRC staff determined, based on historical data, thatthe technical review may require approximately 270 hours0.00313 days <br />0.075 hours <br />4.464286e-4 weeks <br />1.02735e-4 months <br /> and 12 months. To support a more efficient process, the NRC is setting a goal of completing a review in 15% less time and level of effort. Based on that, the staff estimate for this review is approximately 230 hours0.00266 days <br />0.0639 hours <br />3.80291e-4 weeks <br />8.7515e-5 months <br /> and 10 months. The schedule includes the issuance, if needed, of a request for additional information (RAI) by August 2025, and receiving your response by September 2025. The staff expects to complete the formal review by February 2026 and estimate the CoC to become effective in July 2026.

These estimates are based on the staffs initial review of the application and may change due to several factors, including, unanticipated expansion of the review scope, or if the submittal is provided to the NRC in advance of or concurrently with industry program initiatives or pilot applications.

The schedule above is also partly based on NAC providing RAI responses by the specified date (unless another date is agreed upon), with those responses resolving issues with minimal need for follow-up. It also depends on prompt scheduling and completion of clarification calls, as well as timely submission of any additional supporting non-docketed information.

To adhere to the projected schedule, NRC staff will engage with NAC on a regular basis to promptly address any emerging issues or challenges that may affect the initial completion date or significantly impact the estimated review hours. Any resulting changes, along with revised estimates, will be communicated through routine interactions with the assigned project manager and appropriately documented. In the event of delays due to other factors, NRC staff will collaborate with NAC to mitigate the impact and maintain the overall schedule.

Your submittal has been assigned Cost Activity Code (CAC)/Enterprise Project Identification Number (EPID) 001028/L-2025-LLA-0084. Please reference this number and Docket No 72-1031 in any future correspondence associated with this request.
