EXEMPTION FROM 10 CFR 50.54(w)(1) FOR THE BIG ROCK POINT INDEPENDENT SPENT FUEL STORAGE INSTALLATION (EPID L-2018-LLE-0017)

Dear Ms. Halter:

This is in response to your letter dated August 10, 2018 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18222A394), requesting an exemption from Title 10 of the Code of Federal Regulations Part 50 Section 54 (10 CFR) 50.54, Conditions of licenses, (w)(1) for dry fuel storage at the Big Rock Point (BRP) Independent Spent Fuel Storage Installation (ISFSI), pursuant to 10 CFR 50.12. 10 CFR 50.54(w)(1) requires the following to power reactor licensees:

1) obtain insurance coverage from private sources;
2) provide protection covering the licensee's obligation (in case of an accident), and
3) stabilize and decontaminate the reactor and the reactor site.

Specifically, licensees must obtain insurance having a minimum coverage limit for each reactor station site. This insurance coverage is referred to as "onsite coverage" or "onsite insurance coverage."

The licensee (Entergy Nuclear Operations, Inc. or ENO) requested an exemption to 10 CFR 50.54(w)(1) to reduce the minimum coverage limit of its onsite insurance coverage from

$1.06 billion to $50 million for BRP. The BRP is a single reactor facility. The facility ceased operation, permanently defueled, and transferred all spent nuclear fuel, special nuclear material, and greater than Class C waste to dry fuel storage systems stored in an ISFSI. The licensee requested this exemption to reduce the amount of onsite insurance coverage for BRP to a level commensurate with an ISFSI.

As discussed in the enclosed Federal Register Notice, the staff determined that this action meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(25).

Therefore, pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment needs to be prepared in connection with this action.
