OF AUGUST 29, 2018, PUBLIC MEETING WITH INTERIM STORAGE PARTNERS TO DISCUSS CONSOLIDATED EMERGENCY RESPONSE PLAN FOR ITS PROPOSED WCS CONSOLIDATED INTERIM STORAGE FACILITY PURPOSE:

For the U.S. Nuclear Regulatory Commission (NRC) staff and representatives from Interim Storage Partners (ISP) to discuss its Consolidated Emergency Response Plan (CERP) for its proposed Waste Control Specialists (WCS) Consolidated Interim Storage Facility (CISF).

MEETING

SUMMARY

On August 29, 2018, NRC staff held a public meeting with representatives from ISP at the NRCs Three White Flint North Building in Rockville, Maryland. Attendees included ISP and its contractors, NRC staff, and members of the public. The list of meeting attendees is in . The discussion followed the agenda provided in Enclosure 2. ISP provided meeting slides prior to the meeting. The meeting slides can be found using Agencywide Documents Access and Management System Accession Number ML18241A329.

After introductions and opening remarks, representatives from ISP made a presentation discussing the CERP for its proposed WCS CISF. In its presentation, ISP provided rationale for submitting a consolidated versus separate Emergency Response Plan (ERP) including the unique location of WCS CISF that merits a CERP, and to ensure the integration of planning/preparedness activities for both the existing WCS Low Level Waste disposal and the proposed WCS CISF facilities. ISP stated that the most important criteria for a consolidated versus a separate ERP is the protection of the public, the workers at both operations, and the environment through containing the event.

A. Rivera-Varona ISP discussed the basis for the Emergency Planning Zone (EPZ) and coordination between Texas and New Mexico. ISP explained that an EPZ is not required for the CISF; however, it does not conflict with NRC requirements and is only an added administrative protection.

According to ISP, the WCS 3.7-mile EPZ is based on the postulated accidents, the doses resulting from the WCS evaluated accidents, and this boundary is set by the existing WCS operations. ISP stated that coordination between Texas and New Mexico is already in Memorandums of Understanding (MOUs) with the City of Eunice, New Mexico; the city of Andrews, Texas; the Andrews Sheriff and Police departments; the Carlsbad, New Mexico Medical Center; and the Permian Regional Medical Center. The coordinated MOUs will be updated to include the WCS CISF once the license is granted and before the receipt of fuel.

ISP also described the emergency response change process that includes both the NRC and the Texas Commission of Environmental Quality. ISP concluded by stating that a CERP would ensure the integration of planning and preparedness activities for both facilities. These activities include development and coordination of the plan, drills, exercises, response and recovery planning facilities. Throughout the meeting, the NRC staff asked questions and provided comments.

After the business portion of the meeting, several members of the public asked questions and provided comments to NRC staff. Several questions made by the public sought clarification on the scope and content of the WCS CERP. Other questions focused on the regulatory basis for the existing emergency response requirements in NRCs regulations. NRC staff provided answers to these questions. Other members of the public sought clarification regarding the transportation of spent nuclear fuel to the proposed WCS CISF site. Although the staff informed members of the public that these questions were outside of the scope of the meeting, the staff provided additional references to documents and informational resources on spent fuel transportation in the environmental report for the WCS CISF and NRCs public website.
