RESUMPTION OF THE U.S. NUCLEAR REGULATORY COMMISSION STAFF REVIEW OF A LICENSE APPLICATION TO CONSTRUCT AND OPERATE THE WASTE CONTROL SPECIALIST CONSOLIDATED INTERIM STORAGE FACILITY, ANDREWS COUNTY, TEXAS, DOCKET NO. 72-1050

Dear Mr. Isakson,

By letter dated June 8, 2018, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18166A003), Interim Storage Partners LLC (ISP), a joint venture of Waste Control Specialists LLC (WCS) and Orano CIS LLC (a subsidiary of Orano USA),

requested that the U.S. Nuclear Regulatory Commission (NRC) resume all safety and environmental review activities associated with the proposed WCS Consolidated Interim Storage Facility (WCS CISF) license application. By letter dated May 10, 2017 (ADAMS Accession No. ML17129A314), NRC staff had previously acknowledged WCSs request to temporarily suspend review activities associated with WCSs April 28, 2016, license application.

In your June 8, 2018, letter supplemented by the July 19, and August 8, 2018, letters (ADAMS Accession Nos. ML18206A482, ML18208A437, and ML18225A074 respectively), you provided Revision 2 of the WCS CISF license application, including Revision 2 of the safety analysis report and Revision 2 of the environmental report. The NRC staff has reviewed your request and concludes that the revised license application provides information sufficient to resume its detailed review. Accordingly, the NRC staff has established a schedule for this review that provides for the NRC staff to issue the first round of safety requests for additional information (RAIs) in two parts, beginning in November 2018 and ending in January 2019. The schedule also provides that, if necessary, a second round of safety RAIs could be issued by NRC staff beginning in May 2019, and ending in July 2019. Additionally, the schedule provides for the NRC staff to issue environmental RAIs in January 2019, and, if needed, a second round of RAIs in May 2019. The NRC staff expects to complete its safety, security, and environmental reviews in August 2020.

This proposed schedule assumes that ISP will provide timely and high-quality RAI responses within 60 days of the receipt of each RAI letter. In accordance with the guidance in LIC-SFM-26, Operational Strategies and Management Expectations (ML16222A251), RAI responses which are not received within the agreed-upon time may result in the review being delayed or suspended. In addition, low-quality RAI responses may be deemed non-responsive and may be grounds for suspending the review. In general, additional changes to the application that are submitted, except for changes made to address the NRC staffs RAIs, may cause a delay in the schedule outlined above.

The NRC staff will resume preparation of an environmental impact statement (EIS) and will continue its safety evaluation of the license application. As described in a July 20, 2017, notice published in the Federal Register (82 FR 33521), the NRC staff will publish a new notice of opportunity to request a hearing. By separate notice, the NRC staff also will re-open the scoping period for the EIS.
