Yankee Atomic Electric Company is only seeking exemption from regulations contained in 10 CFR 73.55. Specifically, pursuant to 10 CFR 73.5, Specific Exemptions, Yankee Atomic Electric Company (YAEC) is requesting a temporary exemption from 10 CFR Part 73, Appendix B, Section I.E., Physical and medical requalification, and the 10 CFR 73.55(r) approved alternative measure in Section 12.2.4 of Revision 19 of the Yankee Rowe (YR) Independent Spent Fuel Storage Installation (ISFSI) Physical Security Plan (PSP) regarding the annual physical requalification frequency requirement.

Request for Additional Information: Yankee Atomic Electric Company Temporary Exemption for Annual Physicals Requirement

Dear Mr. Yorke:

By the attached letter dated May 20, 2020, Yankee Atomic Electric Company (YAEC) requested a temporary exemption from the annual physical requalification requirements for security personnel at Yankee Rowe Independent Spent Fuel Storage Installation.

The U.S. Nuclear Regulatory Commission (NRC) staff is reviewing the application and has determined that the additional information below is required to complete the review.

Consistent with the April 7, 2020, letter issued by Mr. Lubinski (ADAMS Accession No. ML20094G166), an email response to this request is acceptable.

Request for Additional Information (RAI 1)

Pursuant to Section 73.5, Specific exemptions, of Title 10 of the Code of Federal Regulations (10 CFR), the Commission may, upon application by any interested person or upon its own initiative, grant exemptions from the requirements of 10 CFR Part 73 when the exemptions are authorized by law, will not endanger life or property or the common defense and security, and are otherwise in the public interest.

Pursuant to 10 CFR 73.5, YAEC requested a temporary exemption from the annual physical requalification requirements for security personnel in Section I.E., Physical and medical requalification, of 10 CFR 73, Appendix B. YAEC also stated that it will require an exemption to the security and training requirements in Appendix B to Part 73 and associated items in the Yankee Rowe Suitability, Training and Qualification Plan (ST&Q).

However, the Yankee Rowe ST&Q Plan for security personnel is a part of a license condition.

Confirm that YAEC is only requesting an exemption from the requirements in 10 CFR Part 73.
