OF NOVEMBER 21, 2019, MEETING WITH WESTINGHOUSE ELECTRIC COMPANY, LLC TO DISCUSS THE UPCOMING SUBMITTAL OF THE APPLICATION FOR AMENDMENT NO. 5 OF THE STORAGE CERTIFICATE OF COMPLIANCE NO. 1026 FOR THE FUELSOLUTIONS' SPENT FUEL MANAGEMENT SYSTEM (CAC/EPID NOS. 001028/L-2019-LRM-0081)

Background

On November 21, 2019, a partially closed meeting was held between representatives of Westinghouse Electric Company, LLC (Westinghouse) and the U.S. Nuclear Regulatory Commission (NRC) to discuss the upcoming submittal of an application to amend the storage Certificate of Compliance (CoC) No. 1026 for the FuelSolutions' Spent Fuel Management System. The meeting was noticed on November 8, 2019 (ADAMS Accession No. ML19312B514). The list of meeting attendees is provided in Enclosure 1. The non-proprietary presentation slides are in ADAMS under Accession No. ML19338E241, and the proprietary slides are under Accession No. ML19338E244.

Discussion The meeting discussion followed the meeting agenda, which is provided in Enclosure 2.

Westinghouses presentation is provided in Enclosure 3. Westinghouse acquired the intellectual property for the FuelSolutions' Spent Fuel Management System from EnergySolutions and requested transfer of the CoC No. 1026 on September 13, 2019. Westinghouse assumed the responsibilities as the CoC holder and requested this pre-application meeting to discuss their plans to apply for Amendment No. 5 of CoC No. 1026. Westinghouse provided information on the FuelSolutions' system design changes and noted there are seven systems currently in storage at the Big Rock Point Independent Spent Fuel Storage Installation (ISFSI).

Westinghouse provided an overview of the planned submittal of the safety analysis report (SAR)

C. Regan for the SENTRY dry fuel storage system (DSS), which is an updated design of the currently certified FuelSolutions' DSS.

This meeting was held one day after a similar meeting with Westinghouse to discuss the upcoming submittal of the application for renewal of the storage CoC No. 1026 for the FuelSolutions' Spent Fuel Management System (meeting details can be found at ADAMS Accession No. ML20002A279). The NRC staff noted that the concurrent applications for the CoC amendment and the CoC renewal will need to be coordinated, as the CoC renewal will need to address aging management considerations for all structures, systems, and components (SSCs) important to safety (including those proposed in Amendment No. 5). Westinghouse may refer to the NRC guidance on concurrent amendment and renewal applications in NUREG-1927, Section 1.4.6, or NUREG-2215, Section 1.5.5. Westinghouse noted that it will likely address the aging management considerations for the proposed Amendment No. 5 in the renewal application, since the renewal application will be submitted after the Amendment No. 5 application. Westinghouse also noted that Amendment No. 5 will include similar materials and construction methods as those previously included in CoC No. 1026, so it anticipates the aging management review for the proposed amendment no. 5 SSCs will be similar to that for amendment nos. 0-4 of the CoC. The NRC staff also noted that it will need to coordinate its reviews of the amendment and renewal, to ensure that changes made in one application are accounted for in the other application and review. The NRC staff will also consider the review status of the amendment when the renewal application is submitted to determine when to begin its review of the renewal application, including consideration of delaying the start of its review of the renewal application until after it has completed the review of the amendment.

After Westinghouse and NRC representatives completed their discussion for the public portion of the meeting, the meeting was opened to public comments or questions, or which there were none. Following the public portion of the meeting, the discussion continued but was closed to the public due to the discussion including proprietary changes being proposed in the amendment.

Action Items/Next Steps At the time of the meeting, Westinghouse stated plans to submit the Part 72 CoC Amendment No. 5 application in December 2019. Following the meeting, Westinghouse stated that they would be delaying the application submittal.
