Dear Kimberly Manzione:

By letter dated August 30, 2016 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML16250A404), and supplemented by letters dated September 9, 2016 (ML16258A213), November 4, 2016 (ML16313A170), March 3, 2017 (ML17067A058), and August 4, 2017 (ML17229B194), Holtec International submitted an amendment request to the U.S. Nuclear Regulatory Commission (NRC) for the HI-STORM UMAX Canister Storage System, Certificate of Compliance No. 1040.

On January 17, 2018, the NRC accepted the application for review and issued the first set of requests for additional information (RAIs) (ML18018A017). Holtec responded to the first set of RAIs by letters dated February 1, 2018 (ML18036A222), May 23, 2018 (ML18150A340), and October 16, 2018 (ML18304A159). The NRC staff issued the second set of RAIs on September 30, 2019 (ML19259A155), and Holtec responded by letters dated December 15, 2019 (ML20002A299), and March 31, 2020 (ML20104C047). On November 20, 2020, the NRC staff issued follow up criticality RAIs (ML20325A257). On December 15, 2020, the staff held a public meeting to discuss two issues from the RAI responses (ML20366A042).

On April 1, 2021, the NRC issued a delay review letter (ML21091A029) because Holtec requested additional time to respond to some RAIs and the two issues discussed at the public meeting. Holtec submitted draft proprietary supplemental responses to these items on August 11, 2021, followed by the official response on docket on March 3, 2023 (ML23062A662),

and March 16, 2023 (ML23075A067). On March 31, 2023, the staff issued RAIs (ML22258A260) on major issues that needing additional information for the staff to complete the review. The staff held a clarification call on April 11, 2023 (ML23125A115), and a public meeting on June 2, 2023 (ML23165A201), to discuss these RAIs.

By a letter dated June 9, 2023 (ML23160A254), you requested to withdraw the HI-STORM UMAX Amendment No. 3 application from NRC review. This communication serves as our acknowledgement of receipt of your request to withdraw the application and as notification of the termination of the NRC staffs activities on the review of your application. Activity Code/Enterprise Project Identification number 001028/L-2017-LLA-0033 have been closed.

Based on the review of your application to date, the NRC staff has identified the technical areas where additional information is needed to enable the staff to complete this review. Should you decide to resubmit your application, you will need to provide a complete application, including all the technical information identified in the March 31, 2023 RAI letter. We highly recommend a public pre-application meeting before you submit a revised application.
