AMENDMENT NO. 3 TO CERTIFICATE OF COMPLIANCE NO. 1040 FOR THE HI-STORM 100 UMAX CANISTER STORAGE SYSTEM - SAFETY REVIEW DELAY

Dear Dr. Anton:

By letter dated August 30, 2016 (Agencywide Document Access and Management System (ADAMS) Accession No. ML16250A404), and supplemented by letters dated September 9, 2016 (ADAMS Accession No. ML16258A213), November 4, 2016 (ADAMS Accession No. ML16313A170), March 3, 2017 (ADAMS Accession No. ML17067A058), August 4, 2017 (ADAMS Accession No. ML17229B194), February 1, 2018 (ADAMS Accession No. ML18036A222), May 23, 2018 (ADAMS Accession No. ML18150A340), October 16, 2018 (ADAMS Accession No. ML18304A159), Holtec International (Holtec) submitted an amendment request to the U.S. Nuclear Regulatory Commission (NRC) for the HI-STORM UMAX Canister Storage System, Certificate of Compliance (CoC) No. 1040.

The NRC staff issued a request for additional information (RAI) on September 30, 2019 (ADAMS Accession No. ML19259A155), and Holtec responded by letters dated December 15, 2019 (ADAMS Accession No. ML20002A299), and March 31, 2020 (ADAMS Accession No. ML20104C047). The staff reviewed these responses and determined that some of these responses do not provide enough information for staff to complete its detailed review and make the required regulatory findings. On November 20, 2020, the NRC staff issued criticality RAIs (ADAMS Accession No. ML20325A257). In addition, during the public meeting held on December 15, 2020, Holtec indicated that it would provide supplement information to the two issues discussed (ADAMS Accession No. ML20325A257). You have requested additional time to respond to these items.

Earlier, the staff has anticipated resolving all aforementioned issues in April 2021 and issuing the preliminary safety evaluation report in July 2021. Based on recent communications requesting additional time to respond, the staff would not be able to continue the safety review and meet the above schedule. Upon receipt of the additional information, the staff will issue an updated review schedule letter.
