RECORD OF DECISION AND ISSUANCE OF LICENSE TO HOLTEC INTERNATIONAL FOR THE HI-STORE CONSOLIDATED INTERIM STORAGE FACILITY IN LEA COUNTY, NEW MEXICO (DOCKET NUMBER: 72-1051)

Dear President Nygren:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I write to inform you that today I signed and issued a license under Title 10 of the Code of Federal Regulations (10 CFR), Part 72, Licensing Requirements for the Independent Storage of Spent Nuclear Fuel, High-Level Radioactive Waste, and Reactor-Related Greater Than Class C Waste, to Holtec International (Holtec) to construct and operate the HI-STORE Consolidated Interim Storage Facility in Lea County, New Mexico. The license is issued pursuant to the NRCs authority under the Atomic Energy Act of 1954, as amended, based on the determination that Holtecs license application meets the standards and requirements of the Act and the NRCs regulations.

The NRC has also issued a record of decision in support of the NRCs decision to issue the license. Both documents will be available at Agencywide Documents Access and Management System (ADAMS) Package No. ML23075A179 by May 9, 2023. NRC maintains the ADAMS system, which provides text and image files of NRCs public documents. The ADAMS system is accessible on the Internet at http://www.nrc.gov/reading-rm/adams.html.
