OF APRIL 11, 2019, PARTIALLY CLOSED PUBLIC MEETING TO DISCUSS REQUEST FOR ADDITIONAL INFORMATION ISSUED IN CONNECTION WITH NRCS REVIEW OF THE INTERIM STORAGE PARTNERS CONSOLIDATED INTERIM STORAGE FACILITY APPLICATION FOR A FACILITY AT ANDREWS COUNTY, TEXAS PURPOSE:

The purpose of the meeting was for the Nuclear Regulatory Commission (NRC) staff and Interim Storage Partners (ISP) representatives to discuss ISPs April 1, 2019 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19093A183), draft responses to NRC staffs request for additional information (RAI). The RAIs were issued on November 16, 2018 (ADAMS Accession No. ML18320A184), in connection with its review of the license application (previously submitted by Waste Control Specialists) for the proposed ISP Consolidated Interim Storage Facility (CISF). This meeting was noticed on March 28, 2019 (ADAMS Accession No. ML19092A195).

MEETING

SUMMARY

On April 11, 2019, NRC staff held a partially closed Category 1 public meeting with representatives from ISP at the NRCs One White Flint North Building in Rockville, Maryland.

Attendees included ISP and its contractors, NRC staff, and members of the public. The discussion followed the agenda provided in Enclosure 1. NRC and ISP staff and contractors discussed the draft RAI responses (ML19093A183). During the open meeting portion, members of the public were given an opportunity to ask questions pertaining to the draft RAI responses following discussions between NRC and ISP. The list of meeting attendees is provided in Enclosure 2.

C. Regan Following introductions and opening remarks, representatives from ISP discussed with NRC staff about its safety analysis associated with site characteristics of the proposed site per select RAIs requested by the NRC (ML18320A184).

ISP and NRC first discussed RAI 2.6-1, which sought clarification as to surface deformation characteristics at the site. NRC staff emphasized that as new information on this issue was being presented in ISPs draft response to the RAI for the first time for NRCs review, ISP should provide greater information and more detail within its current draft RAI response.

ISP and NRC next discussed RAI 2.6-6, which requested water resource and other information related to the applicants slope stability analysis at the site. NRC staff indicated that the draft RAI response appeared adequate but reminded ISP that information it provides should remain consistent in this RAI response, and throughout other safety analysis report analyses and other RAI responses. Moreover, ISP should provide greater detail when new information is being provided for the first time within RAI responses.

ISP and NRC next discussed RAIs 2.4-1, 2.4-2, and 2.4-3. NRC staff indicated that information provided in draft responses to RAIs 2.4-1 and 2.4-3 appeared adequate. These RAIs requested technical justification for the rating curve of the large playa next to the CISF storage area, and further clarification as to the exact design of the CISF rail side track, respectively.

RAI 2.4-2 sought additional information on the erodibility and long-term erosion of the diversion berms, under normal and extreme precipitation events, through all phases of the proposed CISF facility. NRC staff indicated that ISP should consider presenting procedures in response to the RAI, for addressing erosion issues associated with the diversion berms at the CISF facility.

After the business portion of the open meeting, members of the public participating by phone and in person provided comments to NRC staff. Members of the public emphasized that the availability of meeting materials prior to each meeting was important, and NRC staff indicated that it will seek to make available presentation slides and other information, for future meetings, as soon as practicable prior to such meetings.

The public portion of the meeting adjourned at 1:27 p.m. Following the open portion of the meeting, meeting participants transitioned to the closed portion of the meeting. In the closed portion of the meeting, NRC and ISP participants addressed site-characteristic related RAIs whose discussion would introduce information of a proprietary nature. These RAIs sought information associated with geology, backfill compaction and quality control, and settlement site characteristics at the proposed CISF site.

No regulatory decisions were made at the meeting.
