AMENDMENT NO. 3 TO CERTIFICATE OF COMPLIANCE NO. 1040 FOR THE HI-STORM UMAX CANISTER STORAGE SYSTEM - REQUEST FOR ADDITIONAL INFORMATION

By letter dated August 30, 2016 (Agencywide Document Access and Management System

{ADAMS} Accession No. ML16250A404), and supplemented by letters dated September 9, 2016 (ML16258A213), November 4, 2016 (ML16313A170), March 3, 2017 (ML17067A058),

August 4, 2017 (ML17229B194), February 1, 2018 (ML18036A222), May 23, 2018 (ML18150A340), October 16, 2018 (ML18304A159), December 15, 2019 (ML20002A299), and March 31, 2020 (ML20104C047), Holtec International (Holtec) submitted an amendment request to the U.S. Nuclear Regulatory Commission (NRC) for the HI-STORM UMAX Canister Storage System, Certificate of Compliance (CoC) No. 1040.

The staff issued requests for additional information (RAI) by letters dated January 17, 2018 (ML18018A017), September 30, 2019 (ML19259A155), and November 20, 2020 (ML20325A257). On August 11, 2021, Holtec provided draft responses (nonpublic, proprietary),

followed by formal submission on March 3, 2023 (ML23062A662) and March 16, 2023 (ML23075A067), to some outstanding issues from its responses to NRCs request for additional information (RAI) and the December 15, 2020, public meeting (ML20366A042). The staff has reviewed all responses received and determined that Holtec has not adequately addressed the applicable regulatory requirements. The enclosed RAIs contain some of the most substantive issues for which additional information is necessary for the staff to complete this review.

We ask that you provide the response to the enclosed RAI within 30 days from the date of this letter. If you are unable to meet this deadline, please notify us in writing, within two weeks of receipt of this letter, of your new submittal date and the reasons for the delay. The staff has been working with Holtec to resolve technical issues in the past few years, including through multiple rounds of RAIs, public meetings, and clarification calls, and Holtec has not provided Document transmitted by this letter contains Proprietary Information. When separated from Enclosure 2, this letter is decontrolled.

OFFICIAL USE ONLYPROPRIETARY INFORMATION adequate information to address the applicable regulatory requirements for the issues identified in the enclosure. Without additional information such as that referenced in the attached RAI, the staff is unable to make the findings necessary for the issuance of a CoC in accordance with Title 10 of the Code of Federal Regulations 72.246. If Holtec fails to provide the necessary information in the timeframes outlined above, the staff is prepared to terminate this review based on the staffs inability to make the necessary findings under 10 CFR 72.246, until such time as Holtec is able to provide the necessary information.
