This refers to the special equipment qualification (EQ) team inspection  !

conducted at the Waterford Steam Electric Station Unit 3 during the period of  !

December 8-12, 1986, onsite and subsequently in the NRC Region IV office until i March 13, 1987. The results of that insp'ection are reported in NRC Inspection  !

Report 50-382/86-32. As Mr. James L. Milhoan stated to you during our meeting  ;

on September 1, 1988, we will schedule an enforcement conference in the near i future. The date will be established in a separate lette !

l During the EQ team inspection, seven Potential Enforcement / Unresolved Items l and sixteen Open Items were identified. Subsequently, it has been found that certain of your activities ap) ear to be in violation of NRC requirements although operability aspects iave now been addressed. At the forthcoming j enforcement conference, you should be prepared to discuss your understanding -

These discussions should focus on information related to the November 30, f 1985, deadlines for compliance with 10 CFR 50.49 and possible civil penalties [

applicable to licensees not in compliance with 10 CFR 50.49 as described in I the April 7, 1988, Generic Letter (88-07), Modified Enforcement Policy Relating to 10 CFR 50.49, "Environment Qualification of Electrical Equipment Important to Safety for Nuclear Power Plants." The NRC is particularly j concerned with the number of failures to establish equipment qualification by  ;

the November 30, 1985, deadline identified at Waterford Unit 3 during the NRC l inspection. Discussions should also address evaluation of many of these l issues for reportability under 10 CFR 50.72 and 50.7 In accordance with Section 2.790 of the NRCs "Rules of Practice," Part 2 j Title 10 Code of Federal Regulations, a copy of this letter will be placed in [
