SUBJECT: NRC INSPECTION REPORT NO. 50-382/99-08

Dear Mr. Dugger:

This refers to the inspection co'nducted on April 5-7,1999, at the Waterford Steam Electric

Station, Unit 3 facility. The purpose of the inspection was to follow up on the access

' authorization event that your staff reported on March 23,1999.- The enclosed report presents

the results of this inspection. A telephonic exit meeting was conducted with members of your

staff on April 22,1999.

Based on the results of this inspection, one apparent violation was identified and is being

considered for escalated enforcernent action in accordance with the " General Statement of

Policy and Procedure for NRC Enforcement Actions" (Enforcement Policy), NUREG-1600. )

The apparent violation involved the failure to review and consider derogatory access 1

authorization background information as required by the physical security plan and your

procedure. As a result, an individual, who would not have been granted access, was

erroneously granted temporary unescorted access for a period of approximately 30 days as

discussed in Section S1.1 of the enclosed report. The circumstances surrounding the apparent '

violation, the significance of the issue, and the need for lasting and effective corrective action

were discussed with members of your staff at the inspection exit meeting on April 7,1999, and l

the telephonic exit meeting on April 22,1999. As a result, it may not be necessary to conduct a

predecisional enforcement conference in order to enable the NRC to make an enforcemeni

decision.

o 'In addition, since you identified the violation and based on our understanding of your corrective

actions as discussed in the enclosed report, a civil penalty may not be warranted in accordance

with Section VI.B.2 of the Enforcement Policy. The final decision will be based on your ,

confirming on the license docket that the corrective actions previously described to the staff  !

have been or are being taken.

Before the NRC makes its enforcement decision, we are providing you an opportunity to either

(1) respond to the apparent violation addressed in this inspection report within 30 days of the

date cf this letter or (2) request a predecisional enforcement conference. If a conference is

held, it will be open for public observation. The NRC will also issue a press release to

announce the conference. Please contact Ms. Gail M. Good at (817) 860-8215 within 7 days of-

the date of this letter to notify the NRC of your intended response.
