REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE WATERFORD STEAM ELECTRIC STATION, UNIT 3 (TAC NO. MA6172)

Dear Mr. Dugger:

By your application dated July 15,1999, and affidavit dated April 30,1999, executed by Joseph J. Kelly, Manager of B&W Owners Group Services for Framatome Technologies, Inc.,

you submitted B&W Report 51-1234900-00," Fluence Uncertainty Information For Extending Waterford Unit 3 P-T [ pressure / temperature) Limits to 20 EFPY [ effective full power years],"

dated July 1995, in support of an amendment request and requested that the report be withheld from public disclosure pursuant to 10 CFR 2.790.

The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

D.(ii)c. The use of the information by a competitor would decrease his expenditures, in time or resources, in designing, producing or marketing a similar product. ,

d. The information consists of test data or other similar data

concerning a process, method or component, the application of t which results in a competitive advantage to FTl [Framatome Technologies, Inc.].

e. The information reveals special aspects of a process, method, component or the like, the exclusive use of which results in a competitive advantage to FTI.

We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.

l Therefore, B&W Report 51-1234900-00 marked as proprietary, will be withheld from public disclosure pursuant te 10 CFR 2.790(b)(5) 2nd Section 103(b) of the Atomic Energy Act cf 1954, as amended.

I Withholding from public inspection shall not affect the right, if any, of persons properly and '

directly concerned to inspect the documents, if the need arises, we may send copies of this
