Subjec:: Inspection Nos. 50-277/82-05; 50-278/82-05

This refers to an inspection conducted by a representative of the South Carolina

Department of Health and Environmental Control on February 18, 1982 of a

shipment of radioactive waste from the Peach Bottom Nuclear Power Plant. The

shipment was inspected upon its arrival at the Chem-Nuclear Systems, Inc.

burial site at Barnwell, South Carolina. This matter was also discussed in

your letter of March 2, 1982.

Areas examined during this inspection are described in a report by the represent-

ative of the South Carolina Department of Health and Environmental Control,

which is attached to the NRC Region I Inspection Report enclosed with this

letter. The inspection consisted of a review of shipping papers, placarding,

marking and labeling, radiation measurements, selective contamination surveys,

and examination of the packages and the tractor-trailer.

Based on the results of this inspection, it appears that one of your activities

was not conducted in full compliance with NRC requirements as set forth in the

Notice of Violation enclosed herewith as Appendix A. The violation in Appendix

A has been categorized by severity level in accordance with the NRC Enforcement

Policy (10 CFR 2, Appendix C), published in the Federal Register Notice (47 FR

9987) dated March 9, 1982. You are required to respond to this letter, and in

preparing your response you should follow the instructions specified in Appendix

A. In addition to Appendix A, previous Notices of Violation relating to

preparation of radioactive material for transport were issued to you on June

2,1981 and February 18, 1982.

Our concern over weakness in your program for preparation of radioactive

material for transport was the subject of an enforcement conference call on

March 18, 1982 between Mr. J. W. Gallagher, Manager of Electric Production and

members of hic staff and Mr. R. Starostecki, Director of the Division of

Project and xesident Programs and other members of the Region I staff. In

your reply please describe measures you have taken to assure compliance with

transport requirements.

The item described in the attached Notice of Violation, involving dose rates

in excess of 2 millirem per hour in a normally occupied position of a vehicle,

is classified as a Severity Level IV violation. As indicated in Supplement V

of the NRC Enforcement Policy, significant violations of this type are normally

classified at Severity Level III. However, after careful consideration of the

factors involved in this specific instance, including the facts that the

radiation level was low and was confined to only a small portion of the sleeper

cab, and the potential cumulative exposure to the individuals in the truck was

minimal considering the duration of the trip, we have exercised cur judger.ent

under the NRC Enforcement Policy and have classified this violation at Severity

Level IV. Similar violations of this type in the future may result in additional

enforcement action.

In accordance with 10 CFR 2.790(a), a copy of this letter and the enclosures

will be placed in the NRC Public Document Room unless you notify this office,

by telephone, within ten days of the date of this letter and submit written

application to withhold information contained therein within thirty days of

the date of this letter. Such application must be consistent with the requirements

of 2.790(b)(1).

The responses directed by this letter and the accompanying Notice are not

subject to the clearance procedures of the Office of Management and Budget as

required by the Paperwork Reduction Act of 1980, PL 96-511.
