SURVEILLANCE REQUIREMENTS CONCERNING SECONDARY CONTAINMENT DOORS, PEACH BOTTOM ATOMIC POWER STATION; UNIT NOS. 2 AND 3 (TAC NOS. MA0812, MA0813, MA3896, AND MA3897)

Dear Mr. Edwards:

The Commission has issued the enclosed Amendments Nos. 227 and P30 to Facility Operating License Nos. DPR-44 and DPR-56 for the Peach Bottom Atomic Power Station

~ (PBAPS), Unit Nos. 2 and 3. These amendments consist of changes to the Technical Specifications (TGs) surveillance requirements concoming secondary containment doors, in response to your application dated February 4,1998, as revir.ed by your letter dated September 29,1998.

The Nuclear Regulatory Commission (NRC) staff reviewed your February 4,1998, request and

- discussed its determination with your staff during a telephone conference on July 31,1998.

The NRC staff informed your staff that it cannot approve the licensee's request because the changes requested in the February 4,1998, letter involved changes to the improved TS, and thus, were generic to multiple plants. However, the staff also indicated that it could approve the changes for the secondary containment railroad doors for which plant-specific hardship could be justified. The licensee declined the staff's offer, and indicated that it will pursue generic resolution of secondary containment doors surveillance changes through the Nuclear Energy institute (NEI) underTS Task Force (TSTF). Based on the licensee's response, the staff terminated its technical review action on TAC Nos. MA0812 and MA0813 on August 7, 1998. TAC Nos. MA0812 and MA0813 are, therefore, being closed.

The licensee and NEl submitted parallel requests to the NRC. The licensee submitted a letter o

' dated September 29,1998, to revise its request regarding the secondary containment doors surveillance changes, while NEl requested generic resolution of the issue through the TSTF.

On October 2,1998, the NRC staff approved NEl's request for a generic change to the improved TS. The licensee's September 29,1998, letter provided clarifying information within the scope of the initial Federal Reaister notice that did not change the initial proposed no l significant hanrds consideration determination. That request was reviewed against the staff-approved TSTF 18 generic change to the improved TS. '
