SAFETY EVALUATION OF PROPOSED EMERGENCY ACTION LEVEL CHANGES FOR THE PEACH BOTTOM ATOMIC POWER STATION, UNITS 2 AND 3 (TAC NOS. MA1738 AND MA1739)

Dear Mr. Edwards:

By letter dated April 16,1998, as supplemented by letters dated November 16,1998, January 22,1999 and February 11,1999, PECO Energy Company (the licensee) submitted ,

proposed changes to the Peach Bottom Atomic Power Station, Units 2 and 3, emergency action levels (EALs). The proposed EALs iriceipui:2 the guidance in NUMARC/NESP-007, Revision 2, "'t?+f-i-;y for Development of Emergency Action Levels." NUMARC/NESP-007 was endorsed by the staff in Regulatory Guide 1.101, " Emergency Planning and

. Preparedness for Nuclear Power Reactors," as an acceptable method for meeting the requirements of 10 CFR 50.47(b)(4) and Appendix E to 10 CFR Part 50.

The Nuclear Regulatory Commission (NRC) staff has completed its review of the proposed EALs. As a result of that review, the NRC staff concludes that the proposed EALs are consistent with the guidance in NUMARC/NESP-007, and the identified deviations meet the  !

requirements of 10 CFR 50.47(b)(4) and Appendix E to 10 CFR Part 50. Therefore, the proposed EALs are acceptable. Our evaluations and conclusions are summarized in the I attached safety evaluation. This completes our effort under TAC numbers MA1738 and MA1739.

The proposed EALs incorporate the guidance in NUMARC/NESP-007, Revision 2, " Methodology for Development of Emergency Action Levels." NUMARC/NESP-007 was endorsed by the staff in Regulatory Guide 1.101, " Emergency Planning and Preparedness for Nuclear Power Reactors," as an acceptable method for meeting the requirements of 10 CFR 50.47(b)(4) and Appendix E to 10 CFR Part 50.

The Nuclear Regulatory Commission (NRC) staff has completed its review of the proposed EALs. As a result of that review, the NRC staff concludes that the proposed EALs are -
