SUBJECT: NRC INSPECTION REPORT N05. 50-321/85-32 AND 50-366/85-32 Thank you for your response of April 2,1986, to our Notice of Violation issued on December 12, 1985, concerning activities conducted at your Hatch facilit Our acknowledgement of your initial response in the January 13, 1986, letter was provided in our letter of March 5,1986, in which we have reviewed your denial to one of the two violations identified by our inspectors. Specifically, you denied the alleged violation on failure to make a four hour report to the NRC on the Unit I nonisolable crack in the nitrogen inerting and purge line. We have disagreed with your denial and pursuant to 10 CFR 2.201 required you to submit to this office within 30 days another reply to the violation. This was accomplished in your response of the April 2,1986, lette After careful review of the bases for your denial of the four hour telephone reporting requirement, we agree with your position and have deleted the subject violation from our records. However, we would like to comment on this matte First, in recognizing that the licensee may use engineering judgement and experience to determine whether an unanalyzed condition existed for NRC telephone reporting requirements, our inspectors were uncertain as to whether the shift supervisor had all the facts to make the decision in not making the repor Secondly, we do not expect the licensees to perform in-depth engineering analyses for decision making of four hour reports to the NRC; however, the problem at hand should be technically assessed to the extent possible. And thirdly, for your information only, it is the Commission's policy as stated in the Federal Register, Volume 48, No.168, page 39042, dated August 29, 1983, that when applying engineering judgement, and there is doubt regarding whether to report or not, then the licensee should make the repor We appreciate your cooperation in this matte
