E. l. HATCH NUCLEAR PLANT: ALLEGED INCOMPLETE INFORMATION TO THE NRC REGARDING RELEASE OF CONTAMINATED MATERIAL (CASE NUMBER 2-1998-003)

Dear Mr. Sumner:

Enclosed for your information is the synopsis of the Nuclear Regulatory Commission (NRC)

Office of Investigations report regarding alleged untruthful statements made to the NRC concerning the release of contaminated material to an onsite landfill. During the investigation, two additional concerns regarding the performance of inadequate survey techniques to support the release of materials from the drumming room and the dumping of known radioactive contaminants in the onsite landfill were received and investigated.

The Office of Investigations could not conclude that untruthful statements were provided to the NRC nor that approved radiological survey procedures for the uncon tional release of material r

to the landfill were willfully violated. It did substantiate that a drum of contaminated material was placed in the landfill, but did not find the actions of the responsible supervisor to be willful.

Notwithstanding the investigator's ccnclusion regarding the radiological survey issue, a previous inspection by a NRC radiation specialist identified violations and technical concems associated with the release of radioactive contamination to the landfill. The inspection results documented in Inspection Report 50-321,366/97-12, dated March 10,1998, identified violations resulting from the improper release of low-level radioactive contamination to the onsite landfill, and the failure to maintain pertinent survey and decommissioning records. The technical concerns regarding the radiological surveys included inconsistent staff and management interpretation and implementation of applicable survey release procedures and guidance, and the appropriateness of using hand-held survey meters rather than more gamma-sensitive automated monitoring equipment for surveying the aggregate concrete debris.
