SUBJECT: REPORT N05. 50-321/85-16 AND 50-366/85-16 This refers to your response of July 22, 1985, to our Notice of Violation issued on June 21, 1985, concerning the trip testing of molded case circuit breakers at test currents higher than that specified in the Technical Specifications (TS).

We conclude from our evaluation of your response that the cited violation still exists, since the TS should have been changed to permit such a modification to the specified testing method.

However, we do agree that since this modified method of testing is technically sound, the safety significance of this hiatter is minor.

It has therefore been determined that the cited violation only warrants a Severity Level V.

Accordingly, our records have been changed to reflect as such.

We do bowever, want to point out that in two other instances, identified in Licensee Event Report Nos. 50-366/1984-30, Revision 3 and 50-366/1983-39 (the latter being cited in violation 50-366/83-29-01), similar situations existed where the TS did not reflect the testing method actually being used.

This is being brought to your attention so that your present review of TS will concen-trate on eliminating any other such discrepancies, as well as assuring that verbatim compliance to TS is fully implemented.
