Box 1295 Birmingham, AL 35201 Gentlemen: SUBJECT: NOTICE OF VIOLATION (NRC INSPECTION REPORT NOS. 50-321/88-37, 50-366/88-37 AO 50-424/88-53) This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by A. Tillman on November 2,1988 - January 6,1989. The inspection included a review of activities authorized for your Plant Hatch and Plant Vogtle facilities. At the conclusion of the inspection, the findings were discussed with those members of your staff identified in the enclosed Inspection Report. Areas examined during the inspection are identified in the repert. Within these areas, the inspection consisted of selective examinations of procedures and representative records, interviews with personnel, and observation of activities in progress. Some of the violations of regulatory requirements cited in this report are similar in nature to previously cited violations that resulted in the imposition of civil penalties at Plant Vogtle. While it is recognized that the violations occurred in late 1987, prior to or immediately following full l implementation of corrective actions for the previous violations, it is apparent that in some instances the corrective action was inadequate to preclude recurrence. Conversely, two of the violations identified at Plant Vogtle and one violation identified at Plant Hatch were categorized as licensee l identified non-cited violations, due to occurrence prior to full implementation l of acceptable corrective action for previous violations in the case of Plant l Vogtle, and self-identification and appropriate corrective action for the violation at Plant Hatch. Because "similar violations", as described in the NRC Enforcement Policy are of significant concern to the NRC, please give particular attention in your response to the identification of the root cause of these problems at Plant Hatch and Plant Vogtle, and your corrective action to preclude recorrence of violations resulting from the failure to: control access to protected areas, adequately protect safeguards information, and report safeguards events. In accordance with 10 CFR 2.790(d) and 10 CFR 73.21, safeguards activities ano security measures are exempt from public disclosure.
