NRC. INSPECTION REPORT-N05. 50-321/88-37 AND 50-366/88-37

Thank you' for your . response of. June 22. 1989, to our Notice of Violation issued
on May 31,1989, concerning activities conducted at your Plant Hatch facility
under NRC License Hos. OPR-57 and NPF-5.
In ~ your -response, you acknowledged the occurrence of the. violation relating to
the unauthorized entry of _a child into the protected area, but expressed the
. belief..that -the . violation was inconsistent with current NRC philosophy of-
performance based inspections' due to the event having no ' safeguards sign-
ificance.
Your? response further denied the violation relating to the failure

- to report the event.
After careful consideration of the-basis for_ your denial,
. we have concluded, for the~ reasons presented in the enclosure to this_-letter,
Lthat -the violation occurred as ' stated in the Notice of Violation.
Therefore,
in accordance with 10 CFR 2.201(a),'please submit to this office.within 30 days
of the date: of; this letter, a_ written statement describing steps which have
.
been taken to correct the violation denied and the results achieved, corrective
steps which will be -taken to avoid further violations, and the date when full
compliance will be achieved.
The incident'itself indicates a very low regard by the security. staff for their
ownL program and procedures.
Further, the attitude of management appears to be
supportive of the security staff attitude based on the improper analogy of the
' five year-old child climbing a fence and the failure to initiate an
-investigation into the incident until a substantial period of time (30 days)
.had elapsed.
In accordance with 10 CFR 2.790(d) and 10 CFR 73.21, safeguards activities and
security neasures are exempt from public disclosure.
Therefore, the enclosure
