Dear Mr. Parks:

Thank you for your informative response of February 15,.1989.to our letter of February 1,1989 concerning assurance by All Chemical Isotope Er.richment, Inc.

(A1ChemIE) of adequate decommissioning fonding under 10 CFR 550.33(k) and 550.75.

In examining our liransing review for A1ChemIE, we have concluded that'the decommissioning funding requirements of 10 CFR 650.33(k) and 950.75, which are designed to protect the public health and safety, are not applicable in this instance, where the issue is the protection of the common defense and security.

From this conclusion, we have accepted the financial assurances for protection of the common defense and security already provided'by AlchemIE.

Enclosed is a copy of the letter we have sent A1ChemIE confirming 'this.

The next milestone for AlChemIE to achieve toward issuance by NRC of an Operating License for AlChemIE Facility.1 CPDF will be NRC's determination, as specified by Condition III.9 of Construction Permit No. CPEP-1,-that A1ChemIE has established adequate arrangements for security at the CPDF., As we have 1
