Dear Mr. Bordenick:

This is in response to your letter of February 1, 1990 in which you suggest that the Board hold an on the record telephone prehearing conference in regard to scheduling.

The Board has considered the matter and has concluded that it would be premature to do this considering a lack of a record on which~to act.

It is evident from what you state in your letter of.

January.26, 1990 that the position of the parties is very far apart.

You advised that the Staff is~considering the issuance of-an order that would revoke Construction Permit No. CPEP-1 and CPEP-2, and All Chemical Isotope Enrichment, Inc. seeks to have the captioned proceeding held in abeyance indefinitely.

It appears that a better way to proceed would be for the Staff to file with the Board a specific request for future scheduling and have All Chemical Isotope Enrichment, Inc.

respond, as provided for in the Rules of-Practice.

With that before us, the Board will decide on holding a prehearing
