Dear Administrative Judges:
This is in response to your joint letter dated January 17, 1990, to the undersigned and Stephen A.-Irving, Esq., counsel of record for licensee in-l this proceeding.
You requested information within ten days.(i.e. by January 26,1990) on how Mr. Irving and I expect to move the captioned proceeding on the hearing calendar in this new year.
Mr.' Irving and I conferred by telephone on January 23 and 26,1990 Mr. Irving advised me that it is his desire to have-this proceeding held-in abeyance indefinitely.
I advised him that the NRC staff (Staff) would not agree to this approach.
I also advised Mr. Irving, and take this opportunity _
to advise the Board, that one option the staff has under serious consideration is issuance of a second Order to AlchemIE which would revoke Construction Permit Nos. CPEP-1 and CPEP-2. The basis for such action would be set forth in the Order.
If such an Order is issued I will, of course, immediately provide copies to the Board and Mr. Irving.

- Mr. Irving and I believe, based on the disagreement on whether to hold this I
matter in abeyance, that it would be advantageous to confer by telephone with the Board. We had comtemplated that this could be done today. However, Mr. Irving could not proceed with such a call today because he was ill.
If agreeable to the Board, Mr. Irving and I will contact the Board by telephone when he recovers from his illness (hopefully within a few days).

AlchemIE occupy offices' at the Pine Ridge Office Park in Oakridge although Mr. Irving stated to me that mail for them at that address is forwarded to AlchemIE's Trustee in Bankruptcy. A substitute address that the Staff has for Mr. Irving is:
