After careful consideration of your response, we have con-cluded for the reasons given in the enclosed Order and Appendix that the entire violation occurred, as stated, and was properly classified at Severity Level III.

Order Imposing a Civil Monetary Penalty This refers to your letter dated November 27, 1985 in response to the Notice of Violation and Proposed Imposition of Civil Penalty sent to you by our letter dated October 21, 1985. Our letter and Notice described an event reported to the NRC by members of your staff and the subsequent followup by a Region I inspector that resulted in the identification of a violation of NRC requirements.

In your response, you (1) denied a portion of the violation, (2) requested re-duction of the severity level of the violation, and (3) requested mitigation of the civil penalty. After careful consideration of your response, we have con-cluded for the reasons given in the enclosed Order and Appendix that the entire violation occurred, as stated, and was properly classified at Severity Level III.

However, after further consideration of the fact that you identified and reported two of the openings and have undertaken comprehensive corrective actions, we have decided to mitigate the proposed civil penalty of $50,000 by 50 percent.

Full mitigation is considered inappropriate because of your failure to identify and correct two additional openings in the vital area barrier, and because your corrective actions were not promptly initiated. Accordingly, we hereby serve the enclosed Order upon Boston Edison Company imposing a civil penalty in the amount of Twenty-Five Thousand Dollars ($25,000).

We will review during a subsequent inspection the continued effectiveness of the corrective actions you have already taken as well as those proposed.

The enclosed Appendix contains details of your security program that have been determined to be exempt from public disclosure in accordance with 10 CFR 73.21 (Safeguards Information). Therefore, those portions of the Appendix will not be placed in the Public Document Room and will receive limited distribution.
