SUBJECT:

COMPLIANCE WITH ATWS RULE 10 CFR 50.62 The ATWS Rule (10 CFR 50.62, " Requirements for Reduction of Risk from Anticipated Transients Without Scram (ATWS) Events for Light-Water-Cooled Nuclear Power Plant") requires improvements in the design and operation of commercial nuclear power facilities to reduce the likelihood of failure to shut down the reactor following anticipated transients, and to mitigate the consequences of an ATWS event. The requirements for a boiling water reactor are to install an alterna u rod injection (ARI) system, a standby liquid control system (SLC) and to trip the reactor coolant recirculation pumps (RPT) automatically under conditions indicative of an ATWS.

By letter dated May 20, 1987, you requested Technical Specifications regarding the surveillance test frequency of the ATWS ARI/RPT instruments. The staff responded to your request and issued Amendment 121 to the Pilgrim Technical Specifications dated September 8, 1988. During the staff's review, a request for additional information (RAI) was sent by letter dated September 24, 1987.

Your response was provided by letter dated April 27, 1988.

The SLCS was found acceptable and the Technical Specifications issued in Amendment 102, dated August 5, 1987.

The staff is performing a post-implementation review of the ARI and RPT portions of the ATWS modifications to determine compliance with the ATWS rule. Your letters dated May 20, 1987, April 27, 1988, and the Pilgrim Final Safety Analysis Report provided the information uced for the staff's post-implementation review.

Concerns were identified in diversity and testability of the ARI/RPT and reset I of the ARI system. These concerns were addressed during a meeting in Rockville, l'aryland, on December 9,1988. The testability and reset concerns were resolved and the diversity concern for the ARl/RPT remains unresolved.

The details which support the staff's review and conclusions are included in the enclosed draft Safety Evaluatio,n (SE).

The NRC staff will provide additional guidance on the diversity issue shortly.

We request that you respond to the unresolved diversity concerns identified in the draft SE and provide a schedule for resolution when the additional NRC staff guidance is provided. g '

The staff has noted that the existing technical specifications for the ARI/RPT - -

systems'are acceptable on an interim basis. Guidance will be provided on a generic basis at a later date and a determination made if changes are required to the curren_t Technical Specifications fore these systems. -

The reporting and/or recordkeeping requirements contained in this letter affect fewer than ten respondents; therefore, OMB clearance is not required under P.L. 96 511.
