REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE, PILGRIM NUCLEAR POWER STATlON (TAC NO. MA4497)

Dear Mr. Suillivan:

By your application dated December 21,1998, and affidavit dated December 18,1998, executed by Jerry W. Yelverton of Entergy Nuclear Generation Company, you submitted

" Transfer of Facility Operating License and Materials License and Proposed Amendment" and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. A nonproprietary version was submitted for placement in the NRC public document room.

The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

This information is and has been held in confidence by Entergy Nuclear.

ii.

This information is of a type that is held in confidence by Entergy Nuclear, and there is a rational basis for doing so because the information contains sensitive financialinformation concoming Entergy Nuclear's projected revenues and operating expenses.

iii.

This information is being transmitted to the NRC in confidence.

iv.

This information is not available in public sources and could not be gathered readily from other publicly available information.

v.

Public disclosure of this information would create substantial harm to the competitive position of Entergy Nuclear by disclosing Entergy Nuclear's intemal financial projections and the commercial terms of a unique transaction to other parties whose commercial interests may be adverse to those of Entergy Nuclear.

We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted g

information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.

Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
