Section 170.12(b) of the revised rule provides that for applications for permits, licenses, facility reference design approvals, and special projects ,

which have been on file with the Commission for review for six months or ^-

longer, billings would be made at six-month intervals or when the review is completed, whichever is earlier.

Consistent with the requirements of 10 CFR 170.12(b), we have completed the cost analysis for the Byron 1 OL application review for the period June 24, 1984 through December 22, 1984. The cost through that period is $702,593. The enclosure is a breakdown of the review costs by program office. Based on a reexamination of the costs from the previous billing period by the Office of Nuclear Reactor Regulation (NRR),

contract costs of $15,150 have been added to the costs of Byron 1.

These costs were omitted from the previous billing data (see our letter dated January 6,1986 to you concerning Byron 2). In addition, NRR has notified us to subtract $208 from the previous contract costs. The revised total for this billing period is $717,535. When the costs of

$717,535 are added to the costs of $2,757,405 from the previous billing period, the cumulative costs through December 22, 1984 are $3,474,940.

This total exceeds by $397,540 the maximum fee of $3,077,400 as stated in 10 CFR 170.21. Accordingly,$397,540 has been subtracted from the costs of $717,535, leaving a balance due of $319,995. The Office of Resource Management has been notified to bill your Company for this amount. When making payment, please make reference to the invcice number.
