REVIEW OF COMMONWEALTH EDISON COMPANY'S PROPOSED REVISION 66a TO QUALITY ASSURANCE TOPICAL REPORT, CE-1-A (TAC NOS. MA5491, MAS 492, MAS 493, MAS 494, MAS 495, MAS 496, MAS 497, MAS 498, MA5499, MA5500, MA5508, AND MA5509)
Dear Mr. Kingsley:
By letter dated May 19,1999, Commonwealth Edison Company (Comed) requested NRC review and approval of three proposed changes to the Comed Quality Assurance Topical Report (QATR), CE-1-A, in accordance with the requirements of 10 CFR 50.54(a)(3) and 10 CFR 50.4(b)(7). The proposed changes described in Revision 66a to CE-1-A involve the following:
Based on Comed's determination that there are no longer any safety-related structures, systems, components (SSCs) or activities applicable to the Zion Nuclear Power Station (ZNPS), Units 1 and 2, due to the permanent cessation of operations and the permanent removal of fuel from the reactor vessels, Comed has proposed to apply augmented quality requirements to certain SSCs and activities that have been classified as important to the defueled condition.
The review responsibilities of the Nuclear Safety Review Board (NSRB) are proposed to be revised to only require NSRB review of changes to the Generating Stations' Emergency Plan (GSEP) that require NRC approval prior to implementation in accordance with 10 CFR 50.54(q).
Comed proposed to eliminate from the QATR the Quality Assurance Program Database which contains a cross-reference between the quality assurance program, source documents, implementing procedures, and responsible departments.

While we have not reached a conclusion regarding the acceptability of Comed's determination that there are no longer any safety-related SSCs or activities applicable to ZNPS due to its decommissioning status, we have concluded that the requirements of 10 CFR 50.54(a) do not allow Comed to obviate the requirements of Appendix B to 10 CFR Part 50 and annon 9907230205 990716 E-'27 PDR ADOCK 05000010
O. Kingsley l 10 CFR 50.34(b)(6). Therefore,10 CFR 50.54(a) and 10 CFR 50.4(b)(7) are not the proper vehicles for this request and the change is not acceptable. Accordingly, Comed must either apply for an exemption to the requirements of Appendix B to 10 CFR Part 50 in accordance with 10 CFR 50.12, " Specific exemptions," or provide justification as to why the requirements of Appendix B to 10 CFR Part 50 would not need to continue to be satisfied for nonsafety-related SSCs or activities at ZNPS. Tha staff is pursuing rulemaking to address the applicability of these and other Part 50 requirements to decommissioning facilities.
In' regards to the seconc proposed change, the staff has determined that in requesting a change to NSRB review of activities affecting compliance with 10 CFR 50.47(b)(16) requirements, Comed must also satisfy the reduction-in-effectiveness cnteria set forth in 10 CFR 50.54(q). Therefore, the proposed NSRB review requirements are not acceptable for meeting the 10 CFR 50.47(b)(16) emergency plan requirements.
Regarding the third proposed change, the etaff has determined that the criteria of 10 CFR Part 50, Appendix B will continue to be satisfied without the Quality Assurance Program Database and its elimination is acceptable.
