This is in response to your December 23, 1985 letter to the Controller requesting a due date extension on a portion of Bill No. E0123 which was issued to your Company on December 5,1985 for $131,764. Your Company has requested an extension of the due date until the U.S. Court of Appeals, Seventh Circuit, has made a final determination concerning the challenge to 10 CFR 170 filed by Coanonwealth Edison. The portion of the bill in question is $15,150 which represents the Office of Huclear Reactor Regulation (NRR) contractual services costs for Byron 2.

As we indicated in our letter to your Company dated November 29, 1985 NRR had reexamined the contract costs for Byron 2 and found that $15,150 in costs should have been included in the Connission's previous billing which was made on February 11, .'985. Shce NRR reexamined the $15,150 in contracutal services costs and made a determination on August 30, 1985 (see Enclosure 2 to cur letter to your Company dated November 29,1985) that the costs should be assessed, your request for a due date extension of the bill pursuant to 10 CFR 15.31 is denied.
