Confirmation of Actions Taken in Accordance with Fitness for Duty Rule Requirements The purpose of this letter is to notify the NRC of actions that we have taken in accordance with 10 CFR 26, ? Fitness for Duty Programs." Commonwealth Edison (Comed) Company recently received a request for information from the Equal Employment Opportunity Commission (EEOC). The EEOC had received a letter from a candidate for employment conceming our hiring practices that include requiring pre-employment Fitness For Duty (FFD) information. Based on the letter from the candidate, the EEOC requested personal records for Comed employment applicants for the period January 1,1994 to March 1,1999, who received a background check in accordance with our FFD Program.

10 CFR 26.29 (b), " Protection of Information," states,
" Licensees, contractors, and vendors shall not disclose the personal

information collected and maintained to persons other than assigned Medical Review Officers, other licensees or their authorized representatives
- legitimately seeking the information as required by this part for unescorted access decisions and who have obtained a release from current or prospective employees or contractor personnel, NRC representatives, appropriate law enforcement officials under court order, the subject individual 4
or his or her representative, or to those licensee representatives who have a need to have access to the information in performing assigned duties, including audits of licensee's, contractor's, and vendor's programs, to persons deciding matters on review or appeal, and to other persons pursuant to court order."
The EEOC does not meet any of the above descriptions of persons authorized to receive information collected in accordance with the FFD program; therefore, we have denied their request for information.
