Gentlemen:

This refers to the routine safety inspection conducted by Messrs.

P. G. Brochman, L. N. 01shan, G. L. Pirtle and Ms. N. V. Gilles of this

office from April 1 through May 17, 1989, of activities at Byron Station

Units 1 and 2, authorized.by NRC Operating Licenses No. NPF-37 and

No. NPF-66, and to the discussion of our findings with Mr. R. Ward and

others of your staff at the conclusion of the inspection.

cThe enclosed copy of our inspection report identifies areas examined during

the inspection. -Within these areas, the inspection consisted of a selective

examination of procedures and representative records, observations, and

' interviews with personnel.

No violations of NRC requirements were identified during the course of this

inspection. However, an event which is discussed in paragraph 4, and involves

. the physical inoperability of the 1A Diesel Generator (DG), is of concern to

the NRC. The NRC has evaluated this event and concluded that the

circumstances do not warrant the issuance of a Notice of Violation.

The NRC believes that your staff had taken reasonable precautions to ensure

that the DG should not have become inoperable during its painting. .However.

after the painting was completed, the decision not to perform a routine

I surveillance, within at least 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br />, to ensure that the DG had in fact

remained operable, especially in light of the painting problem experiences

i

on the IB DG, was imprudent and non-conservative.

L in accordance with 10 CFR 2.790 of the Commission's regulations, a copy of

this letter and the enclosure will be placed in the NRC Public Document Room.
