Toledo Edison Company has received an April 10, 1986 let-ter from Thomas C. Brown, a Councilman At Large for Lakewood, Ohio, to'NRC Docketing and Service. Attached to the letter is a resolution (No. 6004-85) passed by the City of Lakewood on January 6, 1986. Mr. Brown states that his letter "will serve I

as an official notice of [his] intent to become a party to the informal hearing as a representative of Lakewood. . . . "

t Toledo Edison Company does not object to the letter and resolution being received as a limited appearance statement.

However, to the extent that Mr. Brown seeks to participate as a party representing Lakewood, Toledo Edison submits that the standards for intervention have not been met. Lakewood is on the western outskirts of Cleveland and is approximately 66 miles from the Davis-Besse site. This distance is too far to confer standing even in an reactor operating license proceed-ing. See Tennessee Valley Authority (Watts Bar Nuclear Plant, Units 1 and 2), ALAB-413, 5 N.R.C. 1418, 1421 n.4 (1977);

Philadelphia Electric Co. (Limerick Generating Station, Units 1

& 2), LBP-82-43A, 15 N.R.C. 1423, 1433 (1982). It is therefore certainly too far to confer standing in a materials licensing proceeding. See Rockwell International (Energy Systems Group Special Nuclear Materials License No. SNM-21), CLI-83-15, 17 N.R.C. 1001, 1005 (1983) (greater proximity should be re-quired in a materials licensing proceeding); Boston Edison Co.

(Pilgrim Nuclear Power Station), LEP-85-24, 22 N.R.C. 97, 99 (1985) (residence 43 miles from a facility held too far to con-fer standing in a proceeding addressing spent fuel storage).

Mr. Brown's lack of standing as a representative of Lakewood would be no different if 10 C.F.R. S 2.715(c) applied.

10 C.F.R. 5 2.715(c) permits an " interested" municipality to participate in a formal reactor licensing proceeding. If none of its citizens has a cognizable interest that might be affected, a municipality cannot be considered " interested."

Toledo Edison knows of no instance in a reactor operating license proceeding where a municipality located more than 50 miles from a site was permitted to participate under 10 C.F.R. i S 2.715(c). i Furthermore, neither the resolution nor the letter identifies with specificity alleged deficiencies in any of Licensee's reports describing and evaluating the disposal of very low level radioactive waste. They provide no citations, no detailed discussion, and no supporting data, materials, or references. The letter and resolution therefore fail to ccm-port with the instructions in your March 10, 1986 Memorandum and Order. For this reason too, Mr. Brown and the City of Lakewood should not be admitted as a party.
