A RESOLUTION i

OPPOSING THE APPLICATION OF TOLEDO E0! SON COMPANY FOR PERMISSION TO SURV RADIOACTIVE SLUDGE AT ITS DAVIS-BE5SE NUCLEAR POWER STATION, AND j

DECLARING AN EMERGENCY.

i WHEREAS, the Toledo Edison Company cf Toledo, Ohio, has filed with the U.S.

j, Nuclear Regulatory Commission an application to amend its license to operate the g Davis-Besse Nuclear Power Station so as to permit said Company to bury radio-l active sludge on the power station site and unrestricted use of said land in the future, and WHEREAS, the premises on which the Davis-Besse Nuclear Power Station is situated I is in the immediate area of the Navarre Marsh Lands adjacent to Lake Erie which is a designated flood plain area subject to flooding by the waters of Lake Erie, and WHEREAS, the burial of radioactive sludge in excavations two feet deep and covered -

by four inches of seeded soil could result in radioactive elements being washed into i

g Lake Erie or seeped into from the proposed burial site and the emission of penetrating ;

I rays of radioactivity for many years in the future, and WHEREAS, exposure to radioactive elements would be physically harmful and sub-stantial detriment to the health and welfare of the residents of the area and could possibly contaminate the drinking water with disease causing radioactive materials which would affect all those persons who rely on Lake Erie for water, not to mention ;

increased lake pollution and resulting harm to all forms of waterlife, and WHEREAS, this Council wishes to make known to the members of the U. S. Nuclear Regulatory Commission its deep concern over the application filed by the Toledo t

Edison Company to bury radioactive sludge at its Davis-Besse Nuclear Power Station, j NOW THEREFORE, BE IT ORDAINED by the Council of the City of Brook Park, j

State of Ohio, that i

SECTION 1: This Council hereby expresses to the members of the Nuclear Regulatory Commission of the United States its deep concern o<er the application of the Toledo e

Edison Company for permission to bury radioactive sludge on its Davis-Besse Nuclear 1

Power Station and strongly urges the Commission to aggressively examine the possible detrimental consequences which could result from the granting of the Toledo Edison,

request and to consc%ntiously do all things necessary to protect the interest of all citizens of the State of Ohio.

i SECTION 2: The Clerk of Council be and is hereby authorized and directed to for- !

, ward certified copies of this resolution to the Secretary of the U. S. Nuclear Regulatory Commission and to Senators John Glenn and Howard Metzenbaum and Congresswoman,

Mary Rose Oakar and Congressman Edward Feighan.

l SECTION 3: It is found and determined that all formal actions of this Council con-i cerning and relating to the adoption of this Resolution were adopted in an open meet-l ;

ing of this Council and that all deliberations of this Council and of any of its com-mittees that resulted in such formal action, were in meetings open to the public, in comp'iance with all legal requirements including Section 121.22 of the Ohio Revised Code.

SECTION 4: This Resolution is hereby declared to be an emergency measure necessary for the immediate preservat.on of the public health, safety and welfare l

of the City of Brook Park, and for the further reason that it is necessary to alert 4

the Nuclear Energy Comrnission, at the ea'liest possible time, of our deep corcern l

I over the possible detrimental effect this procedure would create for the citizens of I Brook Park; therefore, this Resolution shall take effect and ' e in force immediately
