Withdrawal of License Amendment Applica: ion to Revise Technical Specifications and Associated Bases for Pressurizer Code Safety Valve Lift Setpoint Tolerances (TAC 93815; LAR 94-0010)

Ladies and Gentlemen:

By letter (Serial Number 2325) dated September 29,1995, the Davis-Besse Nuclear Power Station (DBNPS), Unit Number 1, submitted an application to amend the Operating License NPF-3, Appendix A, Technical Specifications. The proposed changes involved Technical Specification (TS) 3/4.4.3, Safety Valves and Pilot Operated Relief Valve - Operating , and associated Bases 3/4.4.2 and 3/4.4.3, Safety Valves.

Specifically, the proposed changes would have modified the allowable as-found pressure lift setting tolerance of the two Pressurizer Code Safety Valves.

This application's content relied upon the results from a new startup accident analysis performed using the RELAP5/ MOD 2-B&W computer code. The RELAP5/ MOD 2- f B&W computer code had been previously submitted under separate letter on August 14,

1995, to the NRC for approval as Topical Report B AW-10193P. At present, the NRC staff's review of Topical Report B AW-10193P has not been completed.

Completion of the NRC staff's review and approval of Topical Report B AW-10193P is deemed necessary in order for the NRC staff to review and approve this license 0\

amendment application. The DBNPS has been notified by the NRC staff it will be .' O l

required to address, with respect to this license amendment application, the limitations l- and restrictions that the NRC staff's final approval sets upon the use of RELAP5/ MOD 2-B&W. However, the DBNPS cannot complete this task until the NRC staff has approved the use of RELAPS/ MOD 2-B&W.

' The DBNPS is withdrawing this license amendment application for evaluation of the supporting analysis against the limitations and restrictions for use of the computer code that will be set by the NRC staff's final approval of Topical Report BAW-10193P. The DBNPS can then address these limitations and restrictions directly in any resubmittal of the license amendment application. Accordingly, the DBNPS staff requests that the NRC complete its review of Topical Report BAW-10193P.

In addition to the above, should the DBNPS resubmit this license amendment application, it can also consider incorporating results of recent improvements made by Framatome Technologies, Inc. to the water property files used in the startup accident analysis to derive the peak calculated Reactor Coolant System pressure.
