These municipalities are (1) the City of Men-tor, Ohio (Resolution 85-R-134, adopted Dec. 17, 1985): (2) the City of Euclid, Ohio (Resolution 10-1986, passed Jan. 21, 1986): (3) Mayfield village, Ohio (Resolution 86-8, passed Feb.

17, 1986): (4) the City of Willowick, Ohio (Resolution 86-11, passed April 15, 1986) and (5) the City of Rocky River, Ohio (Resolution 29-86, passed April 7, 1986). Mentor, Euclid, Mayfield and Willowick are located on the eastern outskirts of Cleveland, at least 80 miles from the Davis-Besse site. Rocky River is located on the western outskirts of Cleveland, approx-imately 65 miles from the Davis-Besse site.

Since none of these municipalities have requested to in-tervene, their resolutions should be treated as limited appear- ~

ance statements. Moreover, even if the resolutions were con-strued as petitions for leave to intervene -- and they should not be -- these municipalities would not have satisfied the standards for intervention. None of the municipalities has demonstrated injury in fact to themselves. Nor would any of these municipalities have standing if 10 C.F.R. 5 2.715(c) l applied. 10 C.F.R. 5 2.715(c) only permits an " interested" mu-nicipality to participate in a formal reactor licensing pro-

ceeding. If none of its citizens would have standing to inter-vene in a proceeding, a municipality cannot be considered

" interested;" and citizens of a municipality located more than

! 50 miles from a facility lack standing even in a reactor li-censing proceeding. Toledo Edison knows of no proceeding where a municipality located more than 50 miles from a site was per-mitted to participate under 10 C.F.R. 5 2.715(c).

In addition, none of the resolutions identify with partic-ularity alleged deficiencies in any of Toledo Edison's reports describing and evaluating the disposal of very low level radio-active waste. They provide no citations, no detailed discus-sion, and no supporting data, materials, or references. The resolutions therefore fail to comport with the pleading in-structions in your March 10, 1986 Memorandum and Order. For this reason too, the municipalities should not be admitted as parties.
