Dear Members of Council:

Re: Amendment to Toledo Edison operating licence at Davis-Bessie Toledo Edison has requested and the U.S. O clear Regulatory Commision is now holding hearings on the permissability of burying resinous sludge at a marsh on the edge of Lake Erie. If the comison allows this amendment to its operating license Toledo Edison could bury this nuclear waste in an area that has already been flooded at least once. There is no question that this material could seep into Lake Erie and be a hazzard for years or decades to Come.

I am requesting tonight that we have the law director draft a Resolution indicating our opposition to any amendment to the operating license of Toledo Edison that would allow for this burial and open up the area for continu ing of nuclear waste.

Wendling A RESOLUTION expressing to the Nuclear Regulatory Commission of the United States the opposition of the Council of the City of Lsktwood, Ohio, to the appiteation of Toledo Edison Company for pireission to bury radioactive sludge at its Davis-Besse Nuclear Power Station.

WHEREAS, the Toledo Edison Company of Toledo, Ohio, has filed with the U.S.

Nuclear Regulatory Commission an application to Emind its license to operate the Davis-Besse Nuclear Power Station so ca to permit said Company to bury radioactive sludge on the power Ctstion site and unrestricted use of said land in the future, and WHEREAS, the premises on which the Davis-Besse Nuclear Power Ststion situated is in the immediate area of the Navarre Marsh Lands cdjtcent to Lake Erie which is a designated flood plain area subj ect to flooding by the waters of Lake Erie, and WHEREAS, the burial of radioactive sludge in eECavations two foot deep and covered by four inches of seeded soil could result in rsdioactire elements being washed into Lake Erie or seeped into burial from thi proposed radioactivity for many years in the future, andsite and the emmission of penetrating rays of

WHEREAS, exposure to radioactive elements w3uld be phycically harmful and a substantial detriment to the health and celfsre of the residents of the area and could possibly contaminate the drinking water with disease causing radioactive materials which would affect all those persons who rely on Lake Erie for water, not to mention increased lake pollution and resulting harm to all f orms of p.tsrlife, and WHEREAS, this Council wishes to make known to the members of th)

U.S.

Nuclear Regulatory Commission its deep concern over the cpplication filed by the Toledo Edison Company to bury radioactive cluige at its Davis-Besse Nuclear Power Station; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF CHIO:

Section 1.

That this Council for and on behalf of the recifents of the City of Lakewood, Ohio, hereby expresses to the memb:Es of the Nuclear Regulatory Commission of the United States its (cep concern over the application of the Toledo Edison Company for perLission to tury radioactive sludge on its Davis-Besse Nuclear Power St: tion and strongly urges the Commission to aggressively examine the po;sible detrimental consequences which could result from the granting sf the Toledo Edison request and to conscientiously do all things nec;ssary to protect the interest of all citizens of the State of Ohle.

Section 2.

That the Clerk of Council be and she is hereby authorized and directed to forward certified copies of this resolution to the secretary of the U.S.
