Withdrawal of Proposed Changes to DBNPS TS Section 6.8.4.d Concerning 10 CFR Part 20, Appendix B (LAR 97-0015)

Ladies and Gentlemen:

The purpose of this letter is to withdraw a portion of a License Amendment Request previously submitted to the NRC. By letter (Serial Number 2559) dated October 28, 1998, the Davis-Besse Nuclear Power Station (DBNPS) staff submitted a License Amendment Request to the NRC that included proposed changes to the DBNPS Operating License Technical Specifications (TS) Section 6.8.4.d," Radioactive Effluent Controls Program." These changes were proposed pursuant to the latest revision of 10 CFR Pan 20," Standards for Protection Against Radiation," as published in the Federal Register, dated August 15,1994 (59 FR 41643).

1 Included in this License Amendment Request were proposed revisions to TS 6.8.4.d.2 and TS 6.8.4.d.7 to reflect the latest 10 CFR Part 20, Appendix B. Specifically, in TS 6.8.4.d.2 and TS 6.8.4.d.7, references to "..10 CFR Part 20, Appendix B, Table II...." l were proposed to be changed to "...10 CFR Part 20, Appendix B, Table 2...." These C tables ( "II" and "2") contain limitations on radioactive material concentrations released in liquid and gaseous effluents. Under the latest 10 CFR Part 20 requirements, the Table "2" effluent concentration limitations are more restrictive than those in Table "II".

As a result of funher review of the regulatory basis for the more recent Table "2" /

limitations, several telephone conference calls were held between the NRC and the d o[

DBNPS staffs in February,1999. During these calls it was determined that it was not necessary for the DBNPS to change the existing TS 6.8.4.d.2 and TS 6.8.4.d.7 Table "II" references to Table "2." However, at the DBNPS's discretion, the actual DBNPS 9904050157 990319 PDR ADOCK 05000346 p PDR _

,Page 2 program that implements the Radioactive Effluent Controls Program requirements may utilize the limitations listed in the more recent Table "2."

Accordingly, since the above changes to Table "II" are not required, the FirstEnergy Nuclear Operating Company requests rhat the proposed changes to TS 6.8.4.d.2 and TS 6.8.4.d.7 be withdrawn from this License Amendment Request. As discussed between

' the NRC and DBNPS staffs, it is requested that the NRC staff include a brief discussion in their Safety Evaluation for this License Amendment that recognizes it is acceptable for the TS 6.8.4.d.2 and TS 6.8.4.d.7 references to remain as Table "II," and that the DBNPS's program for implementing TS 6.8.4.d.2 and TS 6.8.4.d.7 may be based on the latest 10 CFR Part 20 Appendix B, Table "2."

The October 28,1998, License Amendment Request concluded that the proposed changes have no adverse effect on safety, that the proposed changes do not involve a significant hazards consideration, and that the proposed changes do not constitute an unreviewed safety question. The withdrawal of the proposed changes to TS 6.8.4.d.2 and TS 6.8.4.d.7 do not affect these conclusions.
