CLWU has 11,000 card carrying members, mainly sport fishermen and boaters.
We want permission to intervene in the proceedings wherein Toledo Edison Co. and Cleveland Electric Illuminating Co.
Seek approval from the Nuclear Regulatory Commission to bury low level radioactive dredgings on site at the Davis-Besse Nuclear Electric Power Station complex in Ottawa County, Ohio.
Citizens for Land and Water Use, Inc. received in the mail a xerox copy of the October 9, 1985 Federal Register (50 FR 41265) which contained a notice entitled " Environmental Assessment and Findings of No Significant Impact" dated October 8, 1985, relative to the burial of radioactive sludge on Navarre Marsh:

CLWU HAS STRIVEN FOR TWENTY YEARS TO IMPROVE LAKE ERIE WATER QUALITY, TO ENHANCE THE WALLEYE POPULATION, SAVE THE PERCH AND TO HAVE BETTER AND MORE ACCESS TO LAKE ERIE FOR BOATERS AND PEOPLE.

HOW OUR INTERESTS ARE AFFECTED BY EXISTING CONDITIONS AT THE 4
DAVIS-BESSE NUCLEAR ELECTRIC POWER PLANT.

RDA ON ROM THE TWO SETTLING PONDS ON THE DAVIS-BESSE SITE HAVE BEEN LEA.CHING INTO LAKE ERIE MUCH OF THE POND'S SEVEN YEAR EXISTENCE AND THAT AT A MARCH 1986 LAKE ERIE SPORT FISHING MEETING IN PORT CLINTON, OHIO, A CHARTER BOATER CHALLENGED AN OTTAWA COUNTY INSPECTOR BY SAYING THAT BOTH OF THE DAVIS-BESSE DIKES WERE IN A SERIOUS STATE OF DIS-REPAIR.
THESE FACTS, ABETTED BY 19,86 HIGH LAKE LEVELS GIVE CREDENCE TO LONG TERM RADIOACTIVE LEACHING INTO LAKE ERIE FROM DAVIS-BESSE HOLDING PONDS.
BEING AN ESTABLISHED ENVIRONMENTALIST AS HEAD OF CLWU FOR TWENTY YEARS SHOULD AUTOMATICALLY GIVE ME PERMISSION TO INTERVENE ON BEHALF OF THE COMMON GOOD FOR WHICH I HAVE WHOLE-HEARTEDLY VOLUNTEERED.

CLWU DOES NOT SEEK TO LITIGATE, WE ARE NOT FUNDED.
- HOWEVER, WE WANT IT MADE KNOWN THAT WE DO NOT WANT ANY UNNATURAL RADIATION GOING INTO LAKE ERIE BECAUSE EXPERTS HAVE DETERMINED THAT RADIATION BIO-ACCUMULATES IN FISH, RENDERING THE FISH UNSAFE FOR EATING.
DAVIS-BESSE RADIATION CONTAMINATION OF LAKE ERIE FISH IN THEIR SPAWNING BEDS DOES CANCEL OUR YEARS OF EFFORT'THAT HELPED OHIO'S LAKE ERIE TO BECOME THE WALLEYE CAPITAL OF THE WORLD.
IV.
THE DEFICIENCY OF THE DAVIS-BESSE APPLICATION IS IN PERSISTING IN BURYING ANY RADI0 ACTIVE WASTE IN A MARSH, WITHIN THE GREAT LAKES WATERSHED.
TO DO SO WOULD BE AN ENVIRONMENTAL IMPACT-THAT COULD BE RECOGNIZED AS A VILE ACT AGAINST MANKIND.
