Dear Judge Hoyt:

The Toledo Edison Company et al. has received a service copy of a " Petition to Participate," filed in this oroceeding on April 14, 1986, by Congressman Edward F.

Feighan.

This pe-tition does not indicate how Congressman Feighan wishes to par-ticipate -- whether he wants to be made a party or whether he simply wishes to express his views in a limited appearance statement.

Indeed, Congressman Feighan makes no at-tempt to identify particular deficiencies in Toledo Edison's reports describing and evaluating the burial of very low level waste at the Davis-Besse site; nor does he provide. citation, detailed discussion, data, materials, and references, as your March 10, 1986 Memorandum and Order required of persons who wished to become full parties.

Toledo Edison therefore submits that Congressman Feichan's Petition should be treated as a limited appearance statement.

To the extent that Congressman Feighan's submittal might be construed a petition for leave to intervene as a party, Toledo Edison would object.

As stated in the Commission's February 20 Order and your March 10 Order, a petitioner's standing to participate as a party in this proceeding is gov-erned by existing Commission precedents under 10 C.F.R. 5 2.714(d).

Congressman Feighan has not demonstrated that he meets these standards.

He has not alleged injury in fact to himself or residence in close oroximity to the Davis-Besse site.

Nor can he derive standing from his constituents.

The 19th Congressional District, which Congressman Feighan repre-is over fifty-five miles from the Davis-Besse site.ypt of which sents, comprises suburbs around Cleveland, the near This distance is too far for any of his constituents to have-stand-havestandingastheirrepresentativegyssmanFeighancannot ing in their own right, and hence Cong 1/

Congressman Feighan incorrectly states that the eastern portion of the 19th District lies approximately 30 miles south-west of the Davis-Besse plant.

This description apparently re-fers to the Perry Nuclear Power Plant, rather than the Davis-Besse facility.

Although Congressman Feighan has not requested participa-tion under 10 C.F.R.

S 2.715(c), Toledo Edison would note that it is unavailable to congressmen.
