Dear Judge Hoyt:

On April 10, 1986, Helen L. Waldorf wrote to you on behalf of the Lake Erie Basin Committee of the League of Women Voters.

In her letter Ms. Waldorf proposed to make a statement during the hearisq on the disposal of very low level radiation waste at the Davis-Besse site.

Toledo Edison Company has no objection to treating Ms.

Waldorf's April 10, 1986 letter as a limited appearance state-ment. However, to the extent that Ms. Waldorf seeks to partic-ipate as a party, it does not meet the requirements which have been established. The March 10, 1986 Memorandum and Order 8605050235 ADOCK 0500 060429 6 PDR O

Page 2 stated that a determination whether a petitioner has standing to participate as a party will be governed by existing Commis-sion precedent under 10 C.F.R. S 2.714(d). Neither Ms. Waldorf nor the Lake Erie Basin Committee meet these standards.

Ms. Waldorf's letter indicates that Ms. Waldorf resides in Painesville, Ohio. Painesvilie is approximately 100 miles from the Davis-Besse site. This distance is too far to confer standing even in a reactor licensing proceeding. See Tennessee Valley Authority (Watts Bar Nuclear Plant, Units 1 and 2),

ALAB-413, 5 N.R.C. 1418, 1421 n.4 (1977); Philadelphia Electric I Co. (Limerick Generating Station, Units 1 & 2), LBP-82-43A, 15 N.R.C. 1423, 1433 (1982). It is therefore certainly too far to confer standing in a materials licensing proceeding. See l Rockwell International (Energy Systems Group Special Nuclear Materials License No. SNM-21), CLI-83-15, 17 N.R.C. 1001, 1005 (1983) (greater proximity should be required in a materials 11 ..

censing proceeding); Boston Edison Co. (Pilgrim Nuclear Power Station), LBP-85-24, 22 N.R.C. 97, 99 (1985) (residence 43 miles from a facility held too far to confer standing in a pro-

! caeding addressing spent fuel storage). Ms. Waldorf's letter identifies no other Committee members who might have standing.

l With respect to the Committee itself, Ms. Waldorf states,

"[t]he Committee as such has no personal, financial, or prop-erty interest in this proceeding."

For these reasons, Toledo Edison respectfully submits that l

Ms. Waldorf's letter should only be accepted as a limited ap-pearance statement.
