On May 24, 1988, your May 12 letter to the Atomic Safety and Licensing Appeal Panel entitled "AIR AND WATER POLLUTION PATROL NOTICE OF APPEAL TO MEMORANDUM AND ORDER" was returned to you undocketed by its counsel, Mr. John Cho, for failure to comply with the requirements of 10 CFR 2.701.                  In returning your letter, Mr. Cho advised that if you still wished to pursue your appeal, you should refile the notice of appeal in compliance with Sectior.
2.701, together with a motion for leave to file out of time.
On June 1, 1988 we received in this office an undated letter (postmarked May 30), essentially similar to the one you sent earlier to the Appeal Panel. At the bottom of your one page letter you state: "We certify the above has been served on the latest service list by first class mail from the U.S. Post Office".      Please be advised, that this filing does not comply with the requirements of 10 CFR 2.701. A proper certificate requires that it indicate to the Boards and parties precisely who were served, their mailing addresses, and the date when service was made--e.g., if by mail, the date the document was deposited in the mail.        Your certification fails to meet these requirements.        In addition, your letter was not accompanied by a motion for leave to file your appeal out of time.                    In the circumstances, I am returning undocketed your letter to this office.
For you future reference, I am enclosing an up-to-date service list for this proceeding.

Dear Mr. Romano:

On May 24, 1988, your May 12 letter to the Atomic Safety and Licensing Appeal Panel entitled "AIR AND WATER POLLUTION PATROL NOTICE OF APPEAL TO MEMORANDUM AND ORDER" was returned to you undocketed by its counsel, Mr. John Cho, for failure to comply with the requirements of 10 CFR 2.701.
