Dear Mr. Anthony:

This letter acknowledges receipt of your letter to the Commission dated April 5,1985 commenting with respect to actions being taken regarding your Petitio~n filed pursuant to 10 CFR 2.206 on December 23, 1984. Your request has been referred to me for consideration.

While you style your request to the Commission as an appeal, regulations governing treatment of petitions pursuant to 10 CFR 2.206 do not provide for such a procedure. As I indicated to you in my letter of February 13, 1985, acknowledging the original Petition, I will issue a decision with respect to your Petition within a reasonable time. At that point, pursuant to 10 CFR 2.206(c)(1), the decision will be filed with the Office of the i Secretary for the Commission's consideration pursuant to that section. As noted in 10 CFR 2.206(c)(2), no petition or other request for Commission review of a Director's Decision will be entertained by the Commission.

Accordingly, any appeal to the Commission prior to the issuance of a Director's Decision is inappropriate. However, to the extent your

- submittal of April 5,1985 contains additional substantive information on the items raised in your Petition, such information will be treated as supplemental information and I will consider it in issuing my final i decision.
