Dear Mr. Romano:
At the direction of the Appeal Panel Chairman, I am returning, undocketed, for failure to comply with the provisions of 10 CFR 2.701, your letter entitled "AIR &
WATER POLLUTION PATROL NOTICE OF APPEAL TO MEMORANDUM AND ORDER" of May 5, 1988.
Under that section, all documents offered for filing by mail must, among other requirements, be served upon the Secretary of the Commission as well as upon all parties to the proceeding.
In addition, the filing must b accompanied by proof of service.
Contrary to these requirements, there was no proof of service with your letter indicating any service made.
In this connection, your letter is dated May 12.
We note, however, that the envelope in which it was sent carries a postmark of May 19.
Thus, your letter conveys an erroneous impression of its filing date.
If you continue to desire to appeal the May 5 decision, I suggest that you refile your notice of appeal in compliance with section 2.701 together with a motion for leave to file out of time.
Of course, I cannot guarantee favorable action on such a motion.
We appreciate the fact that you are a non-lawyer.
However, as a long-time party to this proceeding, you should be aware of the repeated admonitions given by the Appeal 8806080125 880524 gDR ADOCK 05000:52 PDR 7/
