Dear Mr. Anthony:
This office has received your pleading dated August 25, 1985 and cap-tioned: " PETITION BY R.L. ANTHONY TO THE SECRETARY FOR LEAVE TO INTERVENE AND FOR A HEARING ON PEC0'S APPLICATION FOR AN AMENDMENT OF LICENSE NPF-39 DATED 8/19/86." As I am sure you are aware, this filing is premature. When the NRC Staff has reached a decision on the application in question, a notice will be published in the Federal Register informing interested persons of their hearing rights, and indicating the procedures for filing petitions. Until that time, the Comission cannot act on your request.
The Office of the Secretary will hold your filing until the Staff has issued its Federal Register Notice. At that time we will formally forward the petition to the Chairman, Atomic Safety and Licensing Board Panel (ASLBP) for appropriate action. However, in the interim, I will send a copy of your filing to the Office of Nuclear Reactor Regulation and to the ASLBP for their information.
