Dear Mr. Anthony:

This is in response to your Petition of March 5, 1986, requesting that the Nuclear Regulatory Commission immediately suspend the license issued to the Philadelphia Electric Company (licensee) authorizing operation of the Limerick Generating Station, Unit 1. Your P! tition to the Conunission has been referred to me for a response pursuant to 1 CFR 2.206. The relief sought by the Petition is based upon alleged vi< ations by the licensee of certain require-ments of the license as containei in the Environmental Protection Plan (EPP).

It is alleged that the EPP was vio'ated during 1985 in that the licensee operated the Limerick facility in a .nde not authorized by the EPP. The allegation is based on the withdrawal ,* water from the Schuylkill River during 1985 under conditions which were specifically reviewed and approved by the Delaware River Basin Commission (DRBC).

A second concern expressed in the Petition was with respect to dissolved oxygen monitors that the Petition alleges have been installed in the Schuylkill River waters and are being operated in violation of the EPP. This monitoring was also in accordance with DRBC approval. I; that the licensee's activities of which the Petition complains have been specifically reviewed and approved by appropriate authorities having jurisdiction over these matters, I see no need to take the immediate action requested in the Petition. This is partic-ularly so as the Petition fails to specify any harm arising from these activities.

Nevertheless, these matters will continue to be pursued by my staff.

The Petition is being treated under 10 CFR 2.206 of the Commission's regulations and appropriate action will be taken in a reasonable time. A copy of the notice that is being filed for publication with the Office of the Federal Register is enclosed for your information.
