} Pursuant to 10 CFR 50.12 and discussions with Messes. Terence Chan and i John Stang of your staff, the following additional information is provided i in regard tu the specific exemptions previously requested per References 1 3

and 3 from the requirements of Appendix R to 10 CFR 50.

t l Special circumstances, as identified in 10 CFR 50.12(11), exist for granting i exemptions requested in References 1 and 3 to the requirements of 10 CFR 50 l Appendix R,Section III.G.2. For each of the exemption requests, applica-

! tion of the regulation is not necessary to achieve the underlying purpose

( of the rule. Rather, modifications required to meet Section III.C.2 of I Appendix R in addition to those described in the requests, would not i enhance fire protection above that already proposed. The specific j exemption requests have been previously submitted to the NRC and address:

a. Fire Areas A4 and A4a as described in Section 5.2.1 of Reference 1 and Sections 280.1, 280.2, and 280.4 of Reference 2.
b. Fire Area El as described in Section 5.2.2 of Reference 1 and I Section 280.1 and 280.7 of Reference 2.

In a separate matter, in response to our conversation with Mr. Chan and Mr. Stang concerning the water curtain between Fire Areas A4 and A4a for the exemption request pertaining to these areas, a field check verified that the lower sprinkler head (below the 40-in. beam) is not below all l cable trays. A sketch of the elevation view is enclosed to ascist in your review. Please note that water flow from the suppression system is designed to be approximately twice that required by the NFPA Code. We believe the existing configuration has the attributes the NRC desires and, therefore, should be acceptable.
