Gentlemen:

-This refers to the Enforcement Conference conducted by Mr. H. J. Miller and

other members of the NRC staff on April 27, 1989, at the Region III Office in

Glen Ellyn, Illinois, regarding the apparent violations identified in NRC

" Inspection. Report No. 50-263/89006(DRS) of activities at the Monticello Nuclear

Power Plant authorized.by NRC Operating License No. DPR-22 and to the discussion

of our: findings with you and other members of your staff.

The April 14,.1989 letter. transmitting the-above report stated that we were

. evaluating appropriate enforcement actions'for the apparent. violations. The-

evaluation hasLbeen completed and the NRC staff has determined that no

enforcement action shall be taken'in regard'to these issues. Our conclusion

is based on new testing, analyses, field inspections, and clarifications

provided by you,during and after the enforcement conference. Details of-

our' review are provided in.Section 3 of this report. Consequently, we have

no further questions regarding this matter at this time.

In accordance with 10 CiR 2.790 of the Commission's regulations, a copy

of' this letter and the en ,losed inspection report will be placed in the

, NRC Public Document Room.

We will gladly discuss any questions you have concerning the Enforcement

Conference.
