SUBJECT: NOTICE OF VIOLATION, NRC INSPECTION REPORT NO. 50-263/88008(DRSS) l l

This refers to the routine safeguards inspection conducted on April 25 through May 3, 1988 at the Monticullo Nuclear Generating Plant. During the inspection, violations of NRC requirements were identified. The details are presented in i the subject inspection report which was sent to you by letter dated June 13, 198 l An enforcement conference was held on June 15, 1988, with you and other members of your staff to discuss the violations, their causes, and your corrective actions, j Violation A in the enclosed Notice of Violation involves a pathway that could '

have provided unauthorized and Lndetected access from a protected area to a vital area. The degraded barrier that provided this pathway may have existed from 1977 until it was discovered by your staff on January 15, 1988. Upon discovery of this' degraded barrier, corrective actions were taken. Violation B involv e a friture to make a timely report of the degraded barrier to the NR Serious consideration was given to categorizing Violation A at a Severity Level III with the attendant civil penalty because the violation was similar to an earlier identified violation, because compensatory measures were not immediately implemented upon discovery by your auditors, and because a proper report was not made. We have been encouraging licensees to conduct detailed technical audits and are pleased to see that in this case, the audit was of sufficient depth to identify this type of violatio You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your respons In your response, you should document the specific actions taken and any additional actions you plan to prwent recurrence. After reviewing your response to this Notice, including your proposed corrective actions and the results of future inspections, the NRC will determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirement The material enclosed contains Safeguards Information as defined by 10 CFR 73.21 and its disclosure to unauthorized individuals is prohibited by Section 147 of the Atomic Energy Act of 1954, as amended. Therefore, with the exception of the cover letter, this material will not be placed in the Public Document Roo The responses d.rected by this letter and the enclosed Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, Pub.
